Chamber of Justice I (#46) was designed to help members understand the basics of the judicial system and procedures in the Dark Jedi Brotherhood. It predates the current Shadow Academy site, which launched in the summer of 2013. The course was retired in November 2016 by Justicar Jac Cotelin and Headmaster Farrin Xies alongside the old Dark Covenant.
Course Notes
1 - Introduction
The operations of the Chamber of Justice are a mystery to most of the Brotherhood's members. The Justicar and his Hands of Justice seem to work independently of the Brotherhood itself, and most members will never be involved in any of its proceedings. This air of mystery surrounding the Chamber often leads to confusion and inaccurate representations. In addition, new members of the Chamber have to be trained in its daily goings-on and judicial processes, which can take up a significant amount of time and prevent the Chamber from operating at peak efficiency. The purpose of this course is to educate members on the workings of the Chamber and act as preparation for future Chamber members. This course is not easy, and you should be ready to do some work to pass it - but it is required if you want to serve on the Chamber, and is recommended for all Brotherhood leaders or members who want to know how exactly the Chamber works.

2 - The Chamber of Justice
Summary
The Chamber of Justice is made up of the Justicar, his two assistants (the Hands of Justice), and three members who serve on the Appeals Panel. The Justicar and his assistants operate independently from the rest of the Dark Council as impartial leaders of justice who defend and interpret the Dark Covenant. The Chamber serves to protect the fun and safe environment the Brotherhood has established, and is run by the Justicar. The Justicar is second to no one with authority in the execution of justice.
The Justicar
The Justicar is responsible for minimizing internal strife and works to maintain stability within the Dark Brotherhood. The Justicar serves primarily as the chief judicial officer of the Brotherhood. He is the chief interpreter of the Dark Covenant and upholds the laws and regulations of the Dark Brotherhood. He has the authority to administer justice as it pertains to those laws and conduct investigations as needed to keep the peace. He works constantly with the Grand Master to mitigate problems and damages as issues arise. The Justicar is charged with ensuring the proper function of the entire Chamber of Justice.
Functionally, the Justicar maintains the day-to-day operations of the Chamber. He maintains communication with the Hands of Justice, mediates conflicts, responds to inquiries, and pushes forward judicial proceedings. He also proposes and advises on possible revisions to the Dark Covenant when applicable.
The Hands of Justice
The Left and Right Hands of Justice serve as extensions of the Justicar's responsibility and authority. On a day-to-day basis the Hands spend their time in the Brotherhood preventing conflict. During the adjudication process, they fill more specific roles outlined below.
The Right Hand of Justice is a member of the Chamber of Justice and serves at the discretion of the Justicar. The Right Hand is charged with upholding the laws of the Covenant and the Brotherhood's rules and regulations. Specifically, the Right Hand of Justice is the chief investigator into claims. He often serves as the prosecution in cases against members, drawing up charges and ensuring that all evidence is accounted for within the case. The Right Hand works closely with the accuser to determine what sort of case should be brought before the court.
The Left Hand of Justice is a member of the Chamber of Justice and serves at the discretion of the Justicar. The Left Hand is charged with upholding the laws of the Covenant and the Brotherhood's rules and regulations. Specifically, the Left Hand of Justice is the counter-weight to the Right Hand's prosecution efforts. He serves as defense counsel and ensures that members have proper knowledge of their rights. He works with the Right Hand of Justice to gain a full discovery of evidence and helps establish a case in defense of the accused.
The Appeals Panel
The Appeals Panel is made up of three active members selected from amongst the Clans by the Justicar, and their terms in office last for six months. The Appeals Panel exists to ensure that Chamber defendants have recourse in the event a Covenant or judicial process error occurs during a trial. The Panel's jurisdiction is very narrow, and it requires a unanimous vote of the Panel to overturn the court's decision.
Role of the Consuls
While the Chamber of Justice attempts to catch and mediate conflicts between members early - Consuls are most often the first leader who a complaint reaches. As masters of their respective Clans, the Consuls have the authority to arbitrate problems that originate there. Most problems can be solved at this level without any involvement by the Chamber of Justice. The Justicar understands this and often works with the Consuls to solve problems quickly.
Role of the Grand Master
While not an official member of the Chamber of Justice, the Grand Master plays an important rule nonetheless. As the head of the organization, the Grand Master is the pinnacle of all the Brotherhood's information. He often consults with the Justicar to ensure all information for a given incident is collected and appropriately forwarded. The relationship is a double-edged sword, because while the GM is a valuable resource, the Chamber is also charged with monitoring his acts to ensure they are in line with the Dark Covenant.
3 - The Dark Covenant
Purpose
The Dark Covenant details the systems and proceedings within the Brotherhood of Dark Jedi. It serves as a guide to the members in the knowledge of our basic structure and shows them the way to our policies and procedures. The Covenant is the written authority that establishes the basic organization, the powers and limits of the leaders, and the rights of the membership. It is the written basis for the authority the Chamber of Justice holds. The purpose of the Covenant is laid out in Article I, Section 1.01. Amending the Covenant
The Dark Covenant is not a perfectly written document, and it often requires changes. The Covenant itself outlines the way these changes are to be made, a process which is supervised by the Justicar to assure compliance. The specific guidelines for amendments are set forth in Article I, Section 1.02 of the Covenant.
At a basic level, the Grand Master can freely amend any section of the Covenant not specifically related to him or the members' rights if he notifies the Dark Council. Similarly the Justicar can freely amend the Judicial article of the Covenant, except the rights of the accused, with the approval of either the Grand Master or the Dark Council. Finally, the Dark Council can freely amend the Covenant except the members' rights and duties of the Grand Master, if a majority agrees on the amendment. All changes to the Covenant must be documented and announced to the membership, none can be made secretly.
Interpreting the Covenant
The Chamber of Justice is the interpreter of the Covenant. In important matters of review, they will convene as a tribunal consisting of the Justicar, Right Hand of Justice and Left Hand of Justice to offer the final interpretation and set precedents.
In practice the Chamber interprets the Covenant much as any governmental court interprets its code of laws. Interpretations have been discussed and decided upon as the Dark Covenant has evolved, and these are used by the Chamber on a day-to-day basis. The Justicar is expected to be aware of these precedents and use them in the pursuit of justice. The authority for interpretation is set forth in Article I, Section 1.03 of the Covenant.
Rights of Brethren
Article II, Section 2.01 of the Dark Covenant lays forth the rights enjoyed by each member of the Dark Jedi Brotherhood. These rights cannot be abused by any other member or leader of the Brotherhood, and this section of the Covenant can only be amended by a 3/4 vote of the Dark Council. The rights are outlined in nine simple points, take time to open the Dark Covenant and read Section 2.01 before continuing on.
Pillars of the Brotherhood
Article V of the Dark Covenant outlines the "Pillars of the Brotherhood". These include the Dark Council, Star Chamber, Shadow Academy, Orders, Clans, Societies, Guilds, and Tribunes. This section describes each pillar along with its responsibilities and authority. It is an important resource for members who wish to better understand the basic structure of the club.
Justice
Article VIII of the Dark Covenant is the most pertinent to the operations of the Chamber of Justice, for it deals with Justice in the club. Divided into nine subsections, the article describes every aspect of the Judiciary from its structure, to the rules and regulations, to juries, sentencing, and appeals. Every member of the Chamber of Justice should be very familiar with this section.
Later in this course we will take an in-depth look at the Brotherhood's Articles of Conduct, and judicial procedure including the rights of the accused, the process of adjudication, juries, appeals, and penalties, so we here we will quickly discuss the other four sections of Article VIII.
Section 8.01 - The Chamber of Justice - This section outlines the structure, appointment, and authority of the Chamber of Justice, as well as it's duty to serve the Brotherhoods members.
Section 8.07 - Penalties - This section names the penalties that can be handed out as sentence to members found guilty of crimes. These punishments include Letters of Reprimand, Probation, rescinded access to communications, revoked medals and citations, demotion in rank, and expulsion from the Brotherhood.
Section 8.08 - Order of Advanced Incarceration - This section outlines order of advanced incarceration, an order that can be given by the Grand Master or Justicar in very specific situations. In times of crisis, when the Brotherhood's security is at risk, or when a member has become an immediate threat to themselves or other members, the GM or JST can give the order. The order suspends the accused from all positions, deactivates his dossier, removes his access to the database, bans him from IRC channels and all other communications media, and any other forms of control not listed. It is only used in extreme circumstances.
Section 8.09 - The Shadow Academy - This section outlines the process of justice in the Shadow Academy. Because the academy handles so many recruits and oftentimes sees many minor infractions, the Headmaster is given the right to administer justice independently from the Justicar in his area. While the Chamber can still pursue charges related to the Shadow Academy, the Justicar normally allows the Headmaster to handle these situations himself.
4 - The Articles of Conduct
Purpose
The Articles of Conduct and Reprimand are contained within Article VIII, Section 8.06 of the Dark Covenant. They contain the basic ten groups of rules that govern the members of the Brotherhood. While they contain the most common and important rules, the list in no way limits the authority of the Justicar. Covenant Amendments, Judicial Decrees and Sovereign Amendments may be used to create new articles and rules.
All members of the Chamber of Justice should be very familiar with the Articles of Conduct and how they relate to daily Brotherhood interactions. Below are brief descriptions of the articles, I recommend you all read Section 8.06 of the Covenant as well.
Discrimination
Members of the Brotherhood must hold all others in equal regard regardless of gender, race, creed, nationality, or sexual orientation. This applies to everyday relations and in situations such as promotions and awarding.
Sexual Harassment
No member of the Brotherhood shall offer sexual liaisons and encounters as merit.
Crude Behavior
It is expected that members maintain an amount of control over themselves in all proper Dark Brotherhood communication.
Dereliction of Duty
Upon accepting the appointment to a position, a member of the Brotherhood accepts all aspects of responsibility associated with said position, if a member fails in his duty, he may be removed.
Abuse of Power
The leaders of the Dark Brotherhood are expected to maintain high levels of integrity while using the powers that have been granted to them by their position.
Verbal Abuse
Members of the Dark Brotherhood are expected to remain civil with each other.
Disreputable Behavior
No member shall willfully partake in any action that brings disrepute onto the Dark Brotherhood, as a whole, Order, Clan, House, Battle team, or individual member. They are expected to act in the organization's best interest.
Cheating
Members who willfully and knowingly exploit, abuse, or otherwise tamper with official game play or official activity in the form of competitions, tests, or other activities will be punished.
Cloning
Cloning, as defined by having one real person acting out the character of multiple persona's in the Dark Brotherhood (i.e.: having 2 PINs and Character Profiles) is illegal in the Dark Brotherhood.
Plagiarism
Any member of the Dark Brotherhood who copies another person's fiction, artwork, or creative idea without giving credit to the source is guilty of plagiarism.
Rites of Combat
The Rites of Combat govern the conduct and punishments for all competitions. The Rites of Combat can be found under the Resources links on the main Brotherhood website.
5 - IRC Guidelines
The Guidelines
The Dark Brotherhood is a FICTIONAL, online FUN gaming environment. As such, the Brotherhood's IRC guidelines are in place to ensure that all members of the Brotherhood can continue to enjoy this environment, while at the same time preventing the enforcers from subjugating the members. As such, operations and conversations between the hours of 4am and 11pm (all times in EST) will be regarded as Family Oriented chat, and behavior will be expected to fit into the implications of this. Between the hours of 11pm and 4am, behavior is expected to remain respectful and any abuse of these off-hours will result in their cancellation. As a general rule of thumb, keep things at a PG-13 level.
General Responsibility
- Do not flood, overuse colors, use autogreets, scripts, or anything else that is annoying.
- Respect all other members of the channel.
- Keep personal arguments and fights to private messages.
- Do not publicly demean someone for your own benefit.
- Do not swear excessively.
- If someone tells you to stop doing something with good reason, respect their wishes.
- Specifically, members should specifically consult the Articles of Conduct from the Dark Covenant (see Crude Behavior, Verbal Abuse, and Sexual Harassment)
NOTICE: Transgressions that take place on IRC will almost always remain on IRC, your punishment for breaking the rules will 99/100 be given on IRC, and it will go no further. In basic terms, you will be held accountable for your actions on IRC, but only rarely will action be taken against you by the Brotherhood judiciary. However, consistent or grievous offenders will be brought before the Chamber and punishment will be given accordingly. If you have any problems with punishment you have received on IRC, by all means feel free to email the Justicar and voice your opinion, but be sure to back up your stance with proof.
Operator Responsibility
- Enforce the rules, but more so, be a pillar of the rules, lead by example.
- Do not be overzealous in enforcing the rules of the Channel, give fair warning before taking any action.
- If you are Away, please mark yourself so in your name, or De-op yourself.
- Do not topic-flood.
Chamber Role in IRC Policing
The Justicar, along with the Hands of Justice, will actively enforce the IRC guidelines in all official Brotherhood channels. These rules are not to be enforced in Clan and House channels unless the respective owners/operators of those channels do so wish to enforce them. The reason for this is that the Dark Brotherhood respects the wishes of each individual Clan and House to operate in their own fashion, and if that fashion is a more adult or free way than Official behavior would dictate, then we the Dark Brotherhood feel they should be able to do so.
However - if there are violations of the Covenants Articles of Conduct in Clan channels, and a member complains, the Chamber will be forced to first work with the Clan summit, and then take it's own action, to prevent such activity in the future.
Admissibility
Anything that any member says in an IRC conversation, no matter what channel or private message in which it was contained, is admissible. Every member is responsible for what they type, just as any person is responsible for everything they say in the real world. Before you type anything into an IRC conversation or an email, stop to think if you would feel comfortable saying it in front of the Grand Master and Justicar - if not, then you should probably reconsider uttering it.
The actual guidelines state:
A member who engages in a discussion through email or a chat program impliedly consents to the dissemination of the email or logs by any person who is in the IRC room or who is the recipient of an email through direct mail, carbon copy or blind carbon copy.
Evidence from IRC or other chat programs, including personal messages and private channels, is admissible in trial. Relevant evidence showing statements directly from the accused or another party will be permitted to prove the truth of the matters stated in the logs. Testimony of a third party simply attesting as to what the accused or any other party said or did will be barred as hearsay.
6 - Judicial Procedure
Introduction
Chamber of Justice proceedings are not the most common Brotherhood event. Generally they are only observed by the members of the Chamber, senior Brotherhood leadership (GM, DGM), and any accused members or jurists. This fact, along with the legalistic style of the Dark Covenant and the limited communications the Chamber has with the members, has led to a certain air of mystery around its proceedings.
This mystery leads to a problem: new members of the Chamber are novices to Chamber proceedings, which slows the process. In addition non-Chamber members do not understand what happens after complaints are filed, through a trial and sentence.
This section is the most crucial of the entire Course, and you should study it carefully. Your grade on the exam for this course will be very dependent upon your understanding of this section.
Judicial Procedure
1. After receiving a formal complaint, the Chamber of Justice investigates the merit of the accusation and informs the Grand Master of the commencement of an official investigation.
In addition, the Chamber has its own investigatory and complaint powers. The Chamber may proceed with its own investigation and complaint at its own discretion without the need for a member submission.
2. After receiving a complaint, the Justicar, the Grand Master or a Hand of Justice may attempt to mediate the dispute to arrive at a settlement. This attempt does not prevent the member from continuing adjudication later if no resolution can be reached.
3. If it is determined by the Chamber there is sufficient merit and the case is still being pursued, then the Chamber works to complete the charge sheet against the accused.
4. The Chamber of Justice must then issue a summary of charges to the accused, and offer the accused the opportunity to enter a plea of innocence or guilt.
If they plead innocent, the Chamber of Justice initiates a Trial by Jury or Trial by Justicar (See next section for how decision is made)
If they plead guilty, the Justicar imposes a sentence.
If the member refuses to plea, the case automatically moves to a Trial by Justicar, and any member failing or refusing to enter a plea waives his right to submit evidence on his behalf
5. Depending on the severity of the potential consequences, the type of trial is chosen:
For all trials in which the proposed penalty is a one-grade Equite or Elder demotion, a two-grade Journeyman demotion, a Letter of Reprimand, one year probation, or a combination of the above, the Justicar, with the advice of his Hands, will determine the guilt or innocence of the accused.
For all other charges, the accused shall choose between Trial by Justicar or Trial by Jury to weigh evidence and determine guilt or innocence.
6. After the conclusion of the trial, the Justicar shall inform the defendant of the verdict, and impose sentence if found guilty
No past offense will have any bearing on the guilt or innocence of a member in any subsequent case. However the Justicar, in the sentencing phase, may consider the prior record of the accused to include convictions.
7. If the member is acquitted of all charges, the accused member may not be retried for the offense that was acquitted, even upon the revelation of new evidence, unless the verdict was delivered through a miscarriage or defamation of the judicial process as determined by the Appeals Panel
This does not apply to admissions of guilt. Any member that admits guilt post-trial may be re-tried and sentenced per that admission.
8. Upon conclusion of the trial, the Justicar shall post the results in a Chamber of Justice Communique. This Communique shall contain a summary of the trial, the result, and the Justicar's opinion. For cases decided by Justicar or Tribunal, this opinion shall contain official explanation for the Chamber's decision. For cases decided by jury, it will contain the reasons for the specific sentence and any other comments the Chamber wishes to include.
9. The Chamber of Justice shall keep records on the members for use in cases of repeat offenses. In addition, the Justicar is responsible for archiving and protecting all Chamber information for future reference.
Note on the Statute of Limitations:
All complaints must be received within three months of the discovery of the underlying event or else they will be dismissed as time-barred. If the complaint is derived from a series of events, the three month time period will begin tolling from the last known event
This Statute applies only to the receipt of the complaint, not the length until delivery of charges or total length of the judicial process. This means that the Chamber must receive a complaint about an incident within three months of its discovery. After that, the Chamber begins the investigation and trial proceedings - which may take longer than three months.
Note on Ex Post Facto:
The Covenant protects Brotherhood members from ex post facto prosecution, or laws that retroactively change the legal consequences of acts committed. In more simple terms, the DB cannot create a rule after the fact to prosecute you for something done in the past.
Note on "Double Jeopardy":
The Dark Covenant protects members against "double jeopardy" prosecutions in section 8.03M. Double jeopardy is a defense that forbids a defendant from being tried a second time for the same crime, unless the verdict was delivered through a miscarriage of the judicial process.
Rights of the Accused
The Rights of the Accused are given in Article VIII, Section 8.02. They outline the rights given to members who are accused of a crime by the Chamber of Justice. It is of the utmost importance that these rights not be abridged, as they form the basis of our fair judicial system. Take time now to review Section 8.02 now.
Juries
Juries are used in any case that meets the specific criteria (see above "Judicial Procedure" section for these criteria). The Dark Covenant outlines the guidelines for juries in Article VIII, Section 8.04. Juries are made up of one member of the Dark Council, and five other random Equite or Elder members, plus alternates. Take time to review Section 8.04 now.
Appeals
The Dark Covenant outlines the appellate structure for the Brotherhood in Article VIII, Section 8.05. The appeals panel has a very narrow jurisdiction, and basically serves to make sure the Chamber of Justice does not abridge the rights given to the accused by committing errors in process.
It is important to note that members cannot appeal every decision made by the Justicar, the Chamber of Justice, or a jury. Valid appeals must point to a specific error made either in the use of the Dark Covenant or the judicial process itself. The Appeals Panel exists to ensure the Chamber correctly follows procedure, not offer guilty defendants a means of escaping punishment.
Penalties
The Dark Covenant outlines the possible penalties for violations Article VIII, Section 8.07. General penalties always include a probationary period along with any other sentence. I recommend that everyone review Section 8.07 to ensure you are familiar with all possible penalties.
7 - Conclusion
This course has covered the five pillars of the Brotherhood that the Chamber is most concerned with. The organization, procedures, and rules enforced are crucial components that must be understood if you want to understand the Chamber itself. As with any legalistic system, there are hundreds of odd situations that don't quite "fit the mold" that is laid out in this course or the Covenant. However, if you understand the foundations, it is always possible to reason your way to the best answer - and that is the purpose of this course: to ground you in the fundamentals of Brotherhood law.

When the Justicar approaches AED Bob, he claims the discussion was in a Clan channel and the CoJ has no authority.
How should the Justicar proceed in this situation? Take it step by step as far through the process as you think it should go. Be sure to cite any specific Covenant articles you refer to.
A: Answers vary
Question 30: "Ashley" is a member who has sent in an application for a Quaestor position. The Consul of the Clan looks over the application, then sends her an email saying that her application looks good, but a little extra effort is necessary to push it over the top.
